Increasing Levels Of Carbon Dioxide - 1491 Words
Increasing levels of carbon dioxide (CO2) have created problematic oceanic conditions that are detrimental towards the livelihood of coral reefs and other marine biota. The high levels of CO2 lead to a decline of ocean pH among other issues such as dramatic changes in oceanic make-up and chemistry. Statistics and data collected has shown that ocean acidification will not only increase but accelerate over the next century. The ocean takes in about 1/3 of anthropogenic carbon added to the atmosphere. Anthropogenic carbon refers to the excess CO2 added to the ocean and atmosphere from human fossil fuel combustion, agriculture, and deforestation. Although much of the damage from human fossil fuel combustion is irreversible, if emissions are decreased dramatically ocean acidification may be constrained. Human fossil fuel combustion, agriculture, and deforestation also increase the atmospheric content of strong acids and bases such as HNO3, H2SO4, and NH3, which decrease the alkalinity o f water as well as pH levels and the amount of dissolved inorganic carbon. Total alkalinity refers to the conserved thermodynamic measure of seawater acid-base chemistry that is equal to the charge difference between cations and anions. These byproducts of anthropogenic activity are only responsible for a small amount of the oceanic acidification, but are denser in coastal waters where the responses can more closely affect humans. This is relevant because policies will need to be created inShow MoreRelatedEarth s Deep Sea Sediment From The Ocean Floor963 Words à |à 4 PagesKelly of UW-Madisonââ¬â¢s Department of Geoscience can study theses samples, which show age, acidity, ocean temperatures and carbon dioxide levels. Character Development Of Holden Caulfield - 1105 Words
Rushil Asudani Mr. Bazinet ENG3UN 11 July 2015 Character Development of Holden Caulfield Change is an essential component in the continued success of the human race and thus important in the development of society. As such, society expects people to constantly change and adapt. Readers typically expect to see the development of characters throughout novels, or other pieces of literature. In the novel, ââ¬Å"The Catcher in the Ryeâ⬠, J. D. Salinger deviates from the normal progression followed by most novels by characterizing the protagonist as an individual undergoing temperamental changes and uncertainty throughout the novel. This novel is known to have attracted criticism from numerous reviewers from all time periods, who tend to make the argument that the novel s main protagonist, Holden Caulfield, does not develop at all throughout the course of the book. However, this is not the case as Holden grows and develops through the book, recognizing specific ideals from the environment that is around him and responding to them. These reactions towards change are seen through Holden s discovery of himself, relationships with other characters and the actions that he decides to take in given circumstances throughout the book. Throughout the course of the novel, Holden goes on a road of self-discovery. This concept is explained by American author Alan Alda when he says ââ¬Å"You have to leave the city of your comfort and go into the wilderness of your intuition (Alda,1980)â⬠. In an establishment where we work as a team communication is important to keep up the group spirit, knowledge about what is happening whilst working with children It is vital to also communicate with other professionals as well such as Doctors nurseââ¬â¢s parents school teachers, social workers there co workers police men fire men etc So it is important that the rest of the team is communicated the information to as well 1. 2 Explain how communication affects relationships in the work setting. Information needs to be passed on to the relevant people keeping in mind the necessity of information to safeguard the internet of children and also protecting them and us as their Careers. I work on a need to know For example whilst I was out during school run time. My assistant was at home. I got a text from a parent that someone else would be coming one hour early than normal to pick up the child. Due to network issues I couldnââ¬â¢t call the assistant. So had to call the parent to tell the person to wait till I got back as I needed to discuss something, also career at home had no idea what was happening, thereafter that day I had a briefing with the parent that I will have to have at least twenty minutes notice before pick up, even if assistant is at home; As I may be out. They will have to wait until I return. Also I had to have a briefing with my assistant that should any of the parents knock on the door and they are unaware they must wait till I return as I may need to talk to the parents/ relay mom information etc. In this way I kept my parents and assistants aware that we need to make sure things are in order. Otherwise things can go out of hand and I need to maintain safeguarding for everyone. I made sure I was clear and precise and to the point and made sure they all understood the importance of the instructions. I felt that as I was the main role leader I should communicate my wants and needs clearly so that the other people working under me will understand the rules and regulations. Also the set out rules and regulations need to be fair and Just- not biased. So the relationship between co-workers will be a happy one and an easy environment where the environment in smooth. With clear understanding colleagues would support each other and this is very vital for a healthy setting. I felt that I kept a professional and friendly approach during my day. At times taking on Jobs where I felt the assistant needed more help made them realize that we are a team not a boss against their employee. In a work environment it is also important to have reviews from parents or co workers that will help improve the setting, so we can reflect on our reactive and take action to enhance it. Another reason why it is important to convey information to one colleague to another is the fact that some children have allergies. Worker did not know about it or didnââ¬â¢t know how or why it is triggered, the child could be in danger. This affects the childââ¬â¢s safeguarding rights and proper training for this was required and full information needed to be shared to protect both the child and the career from a difficult and hazardous situation. If the co worker was absent/away they need to know if something new has happened to make sure they are up to date. I held a session with the assistant, the parent and the nurse involved with the childââ¬â¢s treatment till date. And was given a full training session on how the practical parts of the allergy is dealt with. Observations are an important way to communicate information even for personal settings. Sometimes I am working alone. Doing paperwork helps to structure learning goals and objectives aiming for higher, knowing the childââ¬â¢s potential and aiming to develop any under developed areas. If we communication with children and young people: we need some key skill to make our bobs and skills more competent 0 Being patient= having the ability to control our selves when there is trying situations 0 Listening skills= listen to and understand the child/Rene needs as much as possible 0 Remembering= names, personal preferences special things to them to make them feel like they belong and that this is a place where they are part of a small family 0 Body language = making sure our body language and posture is positive so the children can positively develop 0 Maintaining a good eye = when we talk to children make eye contact so they are aware that the conversation is for them and they are the individual it is aimed at 0 Sensitivity = using word carefully selected 0 Showing warmth love caring, understating, sincerity positive values of others etc 0 Safeguarding = making sure that all their physical and mental interests are always priority. Confidentiality = making sure we do not tell others about what is happening in our settings. So childrenââ¬â¢s information is kept safe For example In my experience I found that sometimes information can be misinterpreted, such as one day I had arranged for a parent to come and meet me at the library, for a session where I would read with the children and she would also articulate with the children. As I had mentioned very briefly that I would be taking them to library A; but she had thought it was library B and went to a different library. However we resolved the issue as soon as I realized and I rerouted to the second library. Luckily there was a telephone conversation in which I had picked up from her that she was in library b and without putting any blame on either side met up at library b instead. Parent realized the misunderstanding and we made sure that in future we will be clear of exact venue as there are a few libraries nearby. Advanced Contract Law and Negotiation â⬠MyAssignmenthelp.com
Question: Discuss about the Advanced Contract Law and Negotiation. Answer: Introduction The contract is an agreement, which formed between two or more than two parties. It is formed when one party makes an offer and another party accepts the offer for performing the contract. The contract is only enforceable when it has formed for enforceable by law and establishes a legally binding. The contract only arises when both of the parties mutually agrees with the terms of the agreement (Ktz, 2017). It should consist of five elements, which includes offer and acceptance, consideration, capacity to the contract, intension to create a legal agreement and certainty (McKendrick 2014). According to the fact of the case, HEALTHY PLC and MEDIQUIP Ltd. wants to form an agreement for buying MRI scanners and installing for the company. The contract is worth 50 million pounds. Therefore, for the formation of the contract, it must satisfy all the terms. It is required to satisfy every important element, which will help to form a valid contract (OLeary 2017). Under the contract law, it is necessary to follow some rules for the formation of a contract. When a contract has formed for the employment or insurance or buying any house or property it should follow all the important elements to make a legally binding. We are required to follow every details of the agreement before we form the contract (Ktz, 2017). In some special matters, for rent agreements, mortgages or loan agreement a contract is always necessary for follow all the areas of law (OLeary 2017). While the formation of law it is required to establish a relationship between the parties. It is one the important area of law because multiple of parties can enter into a contract with mentioned related topics. In a contract, all included facts must relate with the agreement and formed between two or multiple parties. An English contract must include a wide area where it is necessary to follow up all the requirements. Those are: The formation of Contract which includes offer, acceptance, intention and consideration (Ktz, 2017) The capacity to the formation of the contract The contents which includes terms of the contract, exclusion and privities The vitiating factors where contract deals with misrepresentation, duress, illegality and mistakes The discharge where a contract can faced according to the performance agreement, breached and frustration For the discharge of the contract, remedies also applicable which includes damages, injunction and performance (OLeary 2017). For the formation of the contract it is required that a party must offer and another party will accept the offer. The parties must have intention to create a legally binding contract. There should have a mutual consideration for the formation of the contract. According to the performance in the contract, it helps to the parties to communicate with each other in the agreement (Ktz, 2017). The parties who are entering into the contract must have the capacity to understand all the terms and importance of the agreement. The unsound mind person and minors have no capacity to enter into the contract (OLeary 2017). For the content of the contractual agreement must incorporated with definitive promises where the mentioned terms of the agreements deals with between two or multiple parties should. It must be a contract. There should an exclusion clause where it must restrict rights for the parties. The privities of contract set the terms where the contract never confer with the rights for impose the obligations (Dicey, 2017). Under the vitiating factors, misrepresentation defines false facts or statement which against of a valid contract. The duress or coercion occurs where any party involves with violent activities between the parties. The illegal agreement is against of enforceable of law. Mistakes define in the defense where the facts are found voidable (Ktz, 2017). The discharge of contract has found due to the breach of contract and the frustration of purpose where a defense can claim according to the enforcement of the contract (Poole, 2016). When a contract is breached, remedies also claimed by the innocent parties. The damages and compensation can claim from the aggrieved party (OLeary 2017). Bargaining Position According to contract between the HEALTHY PLC and MEDIQUIP Ltd, one is seller and another one is buyer. Therefore, they have fixed the amount already, which is worth 50 million pounds. Now according to the fact of the case study, both of the company has set an agreement where MEDIQUIP Ltd will provide 10 MRI scanners to HEALTHY PLC in exchange of 50 million (Dicey, 2017). According to the terms of the contract, both of the parties have mutual consideration about the sell agreement of the medical equipments (McKendrick 2014). Now according to terms of the formation of the contract it must follow the necessary areas, which includes: The formation of Contract which includes offer, acceptance, intention and consideration The capacity to the formation of the contract The contents which includes terms of the contract, exclusion and privities The vitiating factors where contract deals with misrepresentation, duress, illegality and mistakes (Ktz, 2017) The discharge where a contract can faced according to the performance agreement, breached and frustration (Dicey, 2017) For the discharge of the contract, remedies also applicable which includes damages, injunction and performance (Poole, 2016). For the formation of any contract, the inequity of bargaining power is important where one party bargain in the agreement for a better alternative. When a bargaining occurs in an agreement, one party will get more power to choose for the deal and makes the terms (OLeary 2017). For the inequality of bargaining power, it provides freedom of contract (Ktz, 2017). When the contract is not found to be unequal then the bargaining power provides a justification. According to the implication of the important element, this is enforceable under the law. Schroeder Music Publishing Co Ltd v Macaulay [1974] is one of the famous case where the inequity of bargaining power has adopted by a party for entering in to a legally enforceable contract for buying some goods. Attorney General of Canada v Nav Canada (2008) is another famous case of contract where an agreement has formed between the tenant and landlord. In this case, the disparity of bargaining power and financial resources has established be tween them for adjudicate the disputes (McKendrick 2014). Therefore as per the above discussion, it can be stated that the contract is completely equitable in favors of MEDIQUIP Ltd because the agreement, which has formed between both of them as per their mutual consideration (Poole, 2016). They both also stated the amount of the agreement, which will cost in exchange for MRI Scanners with HEALTHY PLC. The position of the equity of bargaining power is not applicable for one party in this agreement (Ktz, 2017). The agreement between HEALTHY PLC and MEDIQUIP Ltd, which has formed has no place to bargaining powers in the equitable or favors one of the parties (Dicey, 2017). The Contract Clauses A sell agreement has formed between HEALTHY PLC and MEDIQUIP Ltd where one party will buy 10 MRI scanners from another party in exchange of 50 million pounds. Now while the formation of the contract they have formed a goods and services supply agreement where they have included several clauses according to their mutual concern. However, after the formation of the contract, MEDIQUIP Ltd must focus on every clause because sometimes it could be associated with risk factors (OLeary 2017). When a contract is formed, it only focuses on the indemnity clauses, which are added with the associated risk factors for the negligence acts. While the interpretation of the indemnity clause it arrange for the contract with complexities and helps to operate by the parties through the commercial arrangements (McKendrick 2014). The indemnity clauses could define in various forms, which are: Bare indemnities: It defines the risk factors about the liabilities or any damages, which cause due to some specific reasons without any specific limitations (Poole 2016). Reverse or Reflective Indemnities: It defines the losses against the act or omissions which caused by the negligence of the aggrieved arty. Third party Indemnities: It defines the liabilities where a party who is also involved in such situation involves the loss with the claim. Proportionate or Limited Indemnities: It defines the losses where the third party failed to satisfy the terms of the financial obligation where other party also holds the liabilities for such act or omission as guarantor (Ktz, 2017). Party Indemnities: It defines the indemnities, which caused due to the breach of any terms and causes damages to the innocent parties. Financing Indemnities: It has defines the financial losses or damages where the parties faced financial obligation due to the breach of contract (OLeary 2017). The indemnity clauses restrict the rights for the both parties in the agreement. Under this clause, the court also set the limits act the time of the act for the act of breach of the terms (Dicey, 2017). Now the there are several differences between the business and contract of business and the common contract rules will be applicable in these terms. Sometimes a lot of explicitly has found where the indemnity clause has found while the formation of the contract and cause great risks for us (Ktz, 2017). The actual clauses for the indemnity clauses found in different ways. The Actual exclusion clause, which defines the breach of contract that cause due to excludes liability for the breach the terms of contract. The limitation of clause which defines as a claim for any breach of the terms in the agreement and time limitation set the clauses where the commenced of the action of breach occur for a certain time (McKendrick 2014). For the formation of a contract both HEALTHY PLC and MEDIQUIP Ltd has mentioned about the indemnification clause in the agreement. In this contract, they have mentioned about the remedies, which will be available for the customers and the supplier of the equipments. The contract must agree with the terms irrevocably and unconditionally (Dicey, 2017). The supplier is bound to compensate the customers if they have faced any losses due to the use of the equipments. The indemnity clause will only apply when the breach of cause occur due to damages, losses, costs and expenses and it includes the economic loss or loss of profits. The loss must occur due to the act of omission by the aggrieved party (McKendrick 2014). The liability of the utility of indemnity clause only enforceable if there is a breach of contract. It sets a limitation according to the time limits which is at least for 6 years after the commencing the date of breach of the contract (OLeary 2017). The party who is liable for the indemnify clause then the risks of the anticipating liabilities will lie down for the anticipated liabilities and it helps to consider the breach of contract and negligence according to the existing common rights under the law (Poole, 2016). The confine of the effect of the indemnify clause will be helps to rise the damages only for the breach of contract by one of the party and the damages always be compensate for the innocent parties (Ktz, 2017). The compensation always consider as a liquidate damages where it provides the rights of the payment, suspension or termination to the innocent parties. Therefore, it is necessary for MEDIQUIP Ltd must focus on such negligence activities if it occurs due to the negligence act by the HEALTHY PLC then the contract will be breached for and it will become void (McKendrick 2014). All of the contract clauses, which are, mentioned in the agreement between the HEALTHY PLC and MEDIQUIP Ltd, have set the Goods and Services Supply Agreement (Poole, 2016). In the clause 1, it has described about the definition and interpretation about the contract, which includes account manager, APL, business day, confidential information, contract, expiry date, goods, group, IPRs, order, price, senior manager, services, service credits, services levels and start date (Dicey, 2017). Now in this clause the brief description about every detail is required to mention because it will help to understand the importance of the clause (OLeary 2017). According to the clause 2, it describe about the ordering, delivery and acceptance of the good (McKendrick 2014). Now the described clause provides a brief description about the process of ordering the goods, capability of the goods and other terms of negotiation process regarding the delivery of the goods mentioned in this clause. While the delivery of the goods it is also required to provide the information about the details of the goods and how it will deliver the goods to the buyer. The details about the packing is also required while delivery of the goods. Under this clause, the condition of the goods must be same as the time of packaging (Ktz, 2017). Madisons Political Theory
James Madison (1751-1836) was an outstanding political scientist who contributed a great deal to political practice. He always wrote politically purposeful material. Madisonââ¬â¢s contribution to political theory led to his being recognized as the ââ¬Å"father of the constitutionâ⬠. The major purpose in his work was one: to help in the ratification or shaping the American order of politics.Advertising We will write a custom essay sample on Madisonââ¬â¢s Political Theory specifically for you for only $16.05 $11/page Learn More For this, Madison has been acclaimed for developing the revolutionary theory of federalism, while on the other hand he developed the theory of republicanism. These inventions have greatly influenced and shaped the present political order. This paper will actually discuss Madisonââ¬â¢s political theory by detailing its primary features, intellectual character at the time and the problems the theory was intended to addr ess. Liberty This is one area that greatly consumed Madisonââ¬â¢s thought as far as political consciousness was concerned. He therefore, envisaged a different three dimension kind of liberty. Madison felt that liberty was a right that should not be denied to any human being. Due to this he advocated for ââ¬Å"American libertyâ⬠. The other liberty is that which espouses popular sovereignty. Here it meant that government must subordinate to its people and not vice-versa. This is enshrined in the expression that ââ¬Å"All men are born freeâ⬠. In Madisonââ¬â¢s view the sovereignty of the people must be given great importance. To achieve this, human consent must be sought for any government wishing to implement action Madison rates justice as being the end of civil society and also the end of government. He meant that justice precedes liberty. The intention of Madison here was to present a society that boasts of justice and freedom. He also felt that justice plays a ver y crucial role in shaping society. For example, just laws can make men good. There is, in this intention, the hidden element of virtue and morality. Self ââ¬â Government Madison advocated for self-government and the inherent liberties. He asserted that for a government to be said to be free, it must always make sure that its ends are secured. This is even beneficial to the government, since in cases where a government is perceived to be incompetent, then it risks being brought down.Advertising Looking for essay on political sciences? He also averred that such rulers are not good guardians of public good and private rights.à Madison was cognizant of the weakness of human nature. He observed that human beings are prone to vice such as arrogance, violence and ev en other forms of misuse of power, to achieve selfish ends. Through this one can already see that Madison was indirectly advocating for checks and balances in constitutionalism. These checks and balances would limit such misuse of power. So if tools of power are not properly structured to handle such inherent loopholes through which human nature can take advantage, then the society can be doomed by the very people who posed as custodians of their liberties and freedom. For example, in monarchies, the rights and liberties of many could be trampled upon, especially if such were to be headed by a despotic leader. Though Madison asserted that major rule is better than a monarchy or aristocracy, the majority rule could also prove detrimental, especially, if it comprises of a faction ââ¬â a number of people who share some wishes and desires, which may be adversarial to the rest. Madison, in his work, has observed that society is full of these factions, which are usually guided by diff ering religious beliefs, parties etc. He, however, feels that the worst case is usually driven by unequal distribution of wealth. Public officers could also aggravate the situation by usurping the power of the people, hence tyranny. In a nutshell, the intention of this principle is that there should be separation of power so that no section uses power to frustrate the masses. Constitution Madison had a notable Christian background. This background can be seen in the model constitution he propounds. Perhaps, the inquisition time formed the basis of his mindââ¬â¢s invigoration towards the relationship between religion and state. He proposes separation between religion and state. By this separation Madison envisaged a situation where it would now be easy to form national unity, since religious matters had proved quite divisive at the time. The constitution could guide this venture by explicitly reflecting the separation that exists between government and religion. Power was also an important element of the constitution. What needed to provide this was power from the people. He, in effect, felt that for what is in the constitution to be implemented, there must be the enforcer. He thus suggested a national executive to be the one to handle implementation.Advertising We will write a custom essay sample on Madisonââ¬â¢s Political Theory specifically for you for only $16.05 $11/page Learn More National success would be attained if the government effectively played its role of ensuring its custodial role is adhered to. The constitution was actually meant to guard the national good, according to Madison.à Madison also felt that ownership of property is a right, and for the state to take off that role is to deny the citizens of their inalienable right and freedom. He saw class struggle as a cancer for the republic. Thus, representation would serve to cut across the class. It was good for men and women of high integrity to join the le gislature. But this was not going to be for the good of leaders, but for the general good of the masses. Achievement of legislative virtue formed Madisonââ¬â¢s core expectation when he proposed representation. Madison also felt that accumulation of judiciary, legislative and executive power into some hands could lead to tyranny. He therefore proposed separation of power to counter such a situation. Madison hence proposed that such holders should people of high integrity and unrivalled intellectual resources. This could perhaps suggest that maybe by then many did not have the desired intellectual capacity to handle such positions, which needed persons endowed intellectually. Madison, therefore, envisaged a senate that acts as an embodiment of justice, guided by reason and wisdom. Such a ââ¬Ëhigh-tonedââ¬â¢ senate would assure quality legislation. Conclusion James Madison as can be seen from his theory, was an all round theorist. He was aware of the excesses of human nature a nd that is why he proposed a situation where human excesses and weaknesses are put under control. He also did not leave out the damaging effect emotive issues such as religion, class and even partisan considerations could have on national good. It is for this reason that he advocated for the separation of religion from state. All in all, Madison did succeed in bringing to light controls that could curb human excesses, while at the same time guarantee a government that cherishes justice, reason and consent of the people. Living Conditions in cambodia Essays - Southeast Asia, Free Essays Living Conditions in cambodia By: Emily Crume center850008549640 professor G. Ramano ENGLISH 111-61B-B31000000 professor G. Ramano ENGLISH 111-61B-B3 Emily Crume Professor G . Romano English 111-61B-B3 1 December 2016 Annotated Bibliography: Living Conditions in Cambodia An article , written by Anne- Meike Fechter and her contributors, solely focuses on aid work and professionalism . Some criticism and unease is primarily set on how aid workers are benefitting from a system that does not deliver from the poor . The aid industry is described as "careless and greedy . " Fechter states that, "aid workers were straddling contrasting worlds," meaning that aid workers would do what they pleased while the rest of the population was fighting a battle with being poor . Almost everyone "boycotted" aid workers because they did not agree with how they lived . The people living in Cambodia truly believed that aid workers were only in their profession because they had selfish motives . Due to this, all aid workers had become very close among themselves . They had all shaped public and even private understandings of one another . Aid workers being close with others in their own profession ga ve them a sense of comfort . One thing that aid workers all agreed on and thought was interesting was that poverty professionals were living good . For example, even though those living in poverty had little money for their necessities, they still made the best of everything and loved the life that they were living, whereas the aids were maki ng enough money that they did not necessarily understand how someone could live that happily . In Anne's conclusion, she states, "This is borne out by their everyday practices, as far as they are engaged in crafting lifestyles which combine their professional interests with personal, social, and emotional ones . " Professional motives are not only crucial in what it tells us about aid workers, but also reveals some ethics as well . The debate about professional aid workers is even more interesting than a debate on social workers or nurses in the sense that there is substantial data and trials on those issues . Placing professional aids in different categories with a different emphasis rather than their morals blocks necessary debates on this issue/topic of how aid workers are treated and are living in Cambodia . Another article , written by Stephanie Nann , Jean- Phlippe Dousset , Chanthy Sok , Pisey Khim , Sopheap Y, Paul Sorum , and Mullet Etienne, focuses on the allocation of antiretroviral drugs . In 1999 , about 100,000 people were living with HIV and about 6,000 with AIDS . Antiretroviral drugs have always been a very limited supply in Cambodia and less than 20% of people living with HIV benefitted from antiretroviral drugs . In Cambodia, there was a study where four criteria 's were considered . To get the antiretroviral drugs, you would have had to have been in one of these four criteria . The first criterion considered was on a first come first served basis . However, with this, the longer a patient has been waiting would mean that their priority for the drug would eventually become extremely high . The second criterion considered was based on how severe the infection was . However, with this, the lower CD4 count, the higher the patient's priority . The third criterion considered was based on the patient's level of responsibly of their own family . However, if this criterion was applied, the more patients with bigger families, the higher priority that patient had to get the drugs . The fourth criterion was based on the financial situation of the patient's family . However, studies showed that if the family's income was sufficient, then the drugs would most likely be taken and used correctly . If the family's income was not sufficient, then the drugs would most likely not be taken and used correctly, which is a huge issue . One huge concern about antiretroviral drugs is the misuse and abuse . It had become such a huge concern that in the month of June pharmacies and private clinics started banning the selling and buying of medications . The Ministry of
